SENATE CONCURRENT RESOLUTION NO. 75

Requesting the Joint Committee on Government and Finance study the
cost and other issues associated with the No Child Left Behind
Act of 2001.
Whereas, Much concern and debate has occurred about the extent
to which the No Child Left Behind Act has impacted the cost of West
Virginia's public education system; and
Whereas, The increases that have occurred are a result of
meeting the compliance requirements and the proficiency standards
of the No Child Left Behind Act; and
Whereas, A method of calculating the cost of the No Child Left
Behind Act could be developed most efficiently by modifying an
existing cost model to meet the needs of the state; and
Whereas, Other issues that could be studied include whether or
not West Virginia is receiving all of the same flexibilities to its
accountability plan that other states have received and what
changes the state should push for during the next reauthorization
of the No Child Left Behind Act; and
Whereas, The process of reauthorizing the No Child Left Behind Act could begin as early as the summer of 2006; therefore, be it
Resolved by the Legislature of West Virginia:
That the Joint Committee on Government and Finance is hereby
requested to study the cost and other issues associated with the No
Child Left Behind Act of 2001; and, be it
Further Resolved, That the Joint Committee on Government and
Finance report to the regular session of the Legislature, 2007, on
its findings, conclusions and recommendations, together with drafts
of any legislation necessary to effectuate its recommendations;
and, be it
Further Resolved, That the expenses necessary to conduct this
study, to prepare a report and to draft necessary legislation be
paid from legislative appropriations to the Joint Committee on
Government and Finance.
